Reynlow Riders

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

*Note: If applying for a Family Membership, all individuals must submit their own form.

I hereby acknowledge that riding motorcycles and ATVs is dangerous and could involve serious injury, property damage, or even death. In consideration of being permitted to ride on Reynlow Park property, I do hereby for myself, my heirs, and executors release, remise, and forever discharge and agree to indemnify and hold harmless the Reynlow Park Authority, Reynlow Riders Club, the officers and board of directors of each, from any claim, demand, action, or right of action of whatsoever kind, and any cost, loss, or expense in connection with riding or being involved in any event on Reynlow Park property, including any claims or demands for injury or death of any persons or any damage or destruction of any property resulting from or claimed to result from or arise out of an accident or occurrence during the club's operational times.

I hereby release, waive, discharge, and covenant not to sue Reynlow Park, Reynlow Riders Club, any sanctioning organizations, riders, rescue personnel, or any persons, sponsors, advertisers, or any others involved in the operations of the park or club.

If, despite this release, anyone on my behalf makes a claim against the above-mentioned "Releasees," I agree to indemnify and hold harmless the Releasees and their insurance carrier, and each of them from any litigation expenses, attorneys' fees, loss, liability, damage, or costs they may incur due to the claim made against any of the Releasees named above, whether the claim is based on the negligence of the releasee or otherwise.

I hereby agree that this release and waiver of liability, assumption of risk, and indemnity agreement extends to all acts of negligence by the Releasees, including negligent rescue operations, and is intended to be as broad and inclusive as is permitted by law. If any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I swear that I have read this release and waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and voluntarily, without any inducement, assurance, or guarantee being made to me, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
